Q. Does one need to be 50 years of age with 20 years of covered service to be able to retire? Or does a downsizing agency have the ability to waive the rules and permit employees within a year or two of being eligible to retire for the option of retiring early?

A. When an agency is downsizing and employees are given notice that they will be separated, they can retire at age 50 with 20 years of service or at any age with 25. The law doesn’t provide for any waivers of these requirements. You either meet the age and service requirements or you don’t.
