Rehired annuitant

Q. I am looking for the documentation that allows a rehired annuitant to be hired into an acquisition position without the hourly (1,024) limitation on regular positions. Can you assist?

A. Under Section 433(1) of Title 41 U.S. Code, agency heads have the discretion to rehire retirees into acquisition positions without offset to their annuities. Such hiring can only be done on a case-by-case basis on the following grounds: Unusually high or unique qualifications, exceptional difficulty in recruiting a qualified person, or temporary emergency hiring needs. If you were rehired under this authority, the hourly limitation in Section 1122 of Public Law 111-84 wouldn’t apply.
