Q: I have 20 years in the 0081 special retirement program. With the military buy-back, I have 30 years of creditable federal service. If I accept a position as a fire program administrator for the next five years, at the age of 62, will I be able to retire under the special retirement firefighter program? A: Any employee who has 20 years of covered service as a law enforcement officer or firefighter and is at east 50 years old may retire at any time and have that portion of his annuity calculated using the more generous formula. Any service over…

Q. I’m in federal law enforcement (covered), and the Army National Guard. For retirement purposes I need 20 years covered, and 50 years of age to retire? Last year I was involuntarily deployed for 12 months in Afghanistan, and was automatically placed on leave without pay status. I am curious: Do I lose a year of covered law enforcement time because military time is done under the rules governing credit for military service? I’ve heard there was a bill passed that stated that for every year spent deployed over seas, a year is taken off for retirement purposes, or does…

Q. I’m currently in a secondary 1811 position and will be transferring to a new position within the same organization that is not secondary, but primary in classification.  I have no previous primary service.  I would like to change to primary to receive the higher retirement multiple.  Can this be done? A. First go to www.opm.gov/retire/pubs/handbook/C046.pdf and read Subpart 46B3.2; then, after talking with your supervisor, visit your personnel office.

Q. I am in an 1801 covered law enforcement position. Our mandatory retirement age is 57. The last few years’ positions have been posting with a 40 year maximum entrance age, with 20 years going to 60. Are other LEO’s now allowed to work until 60? A. No. However, if a law enforcement officer has completed 20 years of covered service and reached mandatory retirement age, an agency head may, at his sole discretion, allow the employee to continue working until age 60. If an LEO is first hired after age 37, he must be allowed to complete 20 years of…

Q. I am a federal law enforcement officer working in a federal prison.  I will reach mandatory retirement with 20 years in October 2013.  I turn 60 in November 2013.  Can I continue beyond my 60th birthday if supported by the BOP?  Does a decision require review and approval by someone outside the agency or can the director approve? A. To continue your employment beyond age 60, the attorney general would have to make that request to the U.S. Office of Personnel Management. Included in the request, among other things, would be a statement of facts establishing why your continued employment would be…

Q: On Oct. 31, 2007, I reached mandatory retirement age of 57 and  retired as a FERS law enforcement officer with more than 33 years experience. I have a blended retirement of both CSRS and FERS. For whatever reason, I did not receive my lump sum vacation pay of $25,742 until early January 2008. Just recently, I received notice from OPM that because I exceeded the Social Security earnings limit of $13,560 for 2008, I was overpaid in the supplemental security portion of my pension. I did not have any other earned income for 2008. Since I could not have…

Q: If I have 20 years in a federal law enforcement position at age 44, and decide to resign and not work, at what age could I apply for retirement benefits, and would they be calculated as law enforcement formula? I could not retire at 44 in this scenario, correct? Since I would not be 50 I would have to resign, right? Also, if I have 20 years in a federal law enforcement position at 44 and transfer to another non-law enforcement federal position, can I still retire at 50 with law enforcement formula? A: If you resign, you would…

Q: I am a GS-1811 law enforcement officer covered under the early retirement provisions under the Federal Employees Retirement System. I have 10 years of federal service in a covered position (1811). I am contemplating on switching my job to other federal agencies. One position is not covered under the early retirement provisions. If I take the job and retire at my MRA, will I be eligible to receive 1.7 percent per year for last 10 years I worked as GS-1811 although I would not completed required 20 years under the provision? I have contributed additional 0.5 percent to the…

Q: If a FERS-covered LEO elects to take OPM disability retirement, is that LEO’s 25 percent Law Enforcement Availiability Pay included in the salary computation? I do know for the purpose of regular retirement, and when receiving DOL OWCP the 25 percent LEAP is included. I assume it also would be included in the disability salary calculation as well, but I cannot find a written policy anywhere that states this. A: All disability retirement calculations are based on an employee’s highest three consecutive years of average basic pay. Since law enforcement availability pay is considered to be a part of…

Q: I spent just over four years in a primary law enforcement position (1811). I left to take a noncovered position (1801), where I stayed for the next three years and two months. I was recently hired back into the 1811 series (a secondary position) but was not afforded the 6c coverage. My HR office told me that it was due to three years lapsing (between my primary position and this one, I assume). My current position does extend coverage, but only to those who transfer in from a covered position. My question is this: how do I get 6c…
