Q. I retired from a federal law enforcement position on Aug. 31, with 25 years of service at age 53.  I was born in 1957. On Sept. 1, I began working a full-time position with a nonfederal agency. At what age am I subject to the earnings test for my annuity supplement?  Is it age 56 since I was born in 1957? A. Yes

Q. I have searched the questions and have not seen this here (or on the OPM site). I am currently covered by the Law Enforcement retirement (FERS, TSP)and have 11 years in as a law enforcement officer plus three years federal service as a non-LEO.  I am 48 and am considering retirement to go back to school. I may return to federal service at some point, but not as  an LEO.  I would be retiring without having 20 years or the MRA of 50 (my MRA is 57). My questions: 1. Retirement versus resignation. I know there are benefits to…

Q. I will be retiring from a federal law enforcement position at the end of August 2010 with 25 years of service at age 53.  I was born in 1957.  I was eligible to retire at age 50. When am I subject to the earnings test for my annuity supplement?  Is it age 56 since I was born in 1957? A. The Social Security earnings limit applies only to earnings from wages and self employment, not from other sources of income.

Q: I retired from federal service in 2006 under the law enforcement retirement provision. I have since been re-employed by the government with a waiver for a temporary law enforcement position that allows me to receive both my annuity and the full salary of my new job. I have been informed that when my temporary position ends, the Office of Personnel Management will recalculate my retirement. Are there are any special provisions that would apply to my situation due to being re-employed with a waiver? Because I have not been contributing to retirement in my temporary position, would the recalculation…

Q: I am currently in a law enforcement position, as a Federal Employees Retirement System employee, and I am covered under the special group of employees Firefighters, Law Enforcement Officers, and Air Traffic Controllers retirement. I am considering, after 10 years of service, a lateral transfer to a GS-13 position, with the Defense Department (non-law enforcement) with more potential for promotion and a significant decrease on my commute. Since I paid an increase of .5 percent to FERS for 10-plus years, why doesn’t the 1.7 percent transfer in government to government services? A: Under the law, only those special category…

Q: For those covered under the law enforcement provision of the Federal Employees Retirement System, is the Social Security earnings test applied toward funds received from their Thrift Savings Plan if those amounts exceed the earnings test for the special law enforcement officer/firefighter Social Security supplement after their minimum retirement age? A: No. The Social Security earnings test only applies to earnings from wages or self-employment.

Q: I work for the Federal Bureau of Prisons. In November, I will have 20 years’ service in law enforcement and will be 49 years old. If I decide to retire right there and then, do I have to wait an extra year to collect benefits? Can I retire at age 49 with 20 years of law enforcement plus 4 years of active-duty military service? A: No, you can’t retire on an immediate annuity at age 49. You’ll have to wait until age 50 to retire under the special provision for law enforcement officers. You could, of course, resign from…

Q: If I was in a law enforcement-covered position for eight years, then took a noncovered position for seven years, then moved back to a covered position, what time would count toward the LEO-covered retirement? I was told that as long as you had served three years in a covered position, you were vested and your service would continue in the special-category retirement as long as you had no break in federal service. A: As long as you are in a primary law enforcement position for the requisite period of time and have a total 20 years of covered service,…

Q: For 12 years I was a federal police lieutenant (GS-083) working for the Defense Department at China Lake Naval Air Weapons Station, China Lake, California. In 1997, I was offered and approved for the VISP/VERA program. The government had purchased my primary residence at mortgage value as part of the package. They also provided me a severance package as well as all of my retirement contributions. I was 37 when I left government service. Since I was a career civil servant that left under the VISP/VERA program, does the above separation mean that I am retired from civil service?…
